Solicitor, Rosa Alexander has spoken with FQMagazine about there being a rise in grandparents being prevented from seeing their grandchildren.
Grandparents in England and Wales have no automatic right to see their grandchildren following a relationship breakdown, with 42% losing contact in such situations.
To seek legal assistance, grandparents must first gain the Court's permission to apply for a Child Arrangement Order. The Court assesses factors such as the grandparent's connection with the child, the nature of the application and any potential harm caused by the application.
Family Courts acknowledge the valuable role of grandparents and prioritize the child's welfare when considering contact. Parental hostility alone is not a valid reason to prevent contact unless justified by other significant factors.
