Tim Bennett is a partner in our Mental Capacity team. He is senior Court of Protection practitioner specialising in the management of high value financial settlements and complex applications to the Court of Protection. The majority of his clients have suffered a catastrophic event in their lives and have sustained a brain injury. He acts for clients from the very young to those later in life.

Tim is an experienced professional Deputy and Trustee leading complex projects for clients around the construction and adaptation of properties, the employment of large care teams and investment of settlement monies with financial experts – amongst other roles. His practice includes complex applications to the Court of Protection to help facilitate clients live their fullest and happiest lives. This can include typical issues such as Statutory Wills or Gifting applications, to the more esoteric such as capacity to engage in sex, contact with others, social media and the internet.

Tim's experience also includes cross-jurisdictional capacity work as well as complex multi-layered capacity issues, for these with fluctuating and variable capacity. The uniqueness of his clients' circumstances often means that his practice is at the forefront of developments in mental capacity law.

Tim also has a specialism in dealing with capacity issues for HNW clients, bringing together his 'Private Client' expertise with his Court of Protection practice.

Tim is STEP qualified with a background as a Private Client partner with expertise in Wills / Trusts / Estates and Property Law.

Tim is a member of the PDF and also sits on the committee of the Court of Protection Practitioners Association 'COPPA' (south-central) working with others across the profession to share knowledge and best practice amongst fellow practitioners.
